Sustainability is not just a buzzword, it is a regulatory cornerstone. Microplastics, intentionally added to cosmetics for exfoliation or texture, are now under intense legal scrutiny due to their environmental impact, particularly regarding ocean pollution. As a professional in the industry, understanding these shifts is vital for maintaining product compliance. 

What are microplastics? 

In the regulatory world, microplastics are formally known as synthetic polymer microparticles. They are solid plastic particles smaller than 5 mm that are added to mixtures to provide specific functions. They are commonly found in scrubs, toothpaste, shower gels, and other rinse-off products, as well as in "leave-on" cosmetics and makeup. 

Navigating the EU regulatory timeline 

Commission Regulation (EU) 2023/2055 began applying on 17 October 2023, targeting microplastics on their own or intentionally added to mixtures. To support the industry, the EU has established specific transitional periods for cosmetics to phase out these substances: 

    • Rinse-off cosmetics: Restricted after 16 October 2027.

    • Leave-on cosmetics: Restricted after 16 October 2029.

    • Makeup, lip, and nail products: Restricted after 16 October 2035, with a mandatory label requirement starting in 2031. 

Crucially, materials that are natural, biodegradable, or soluble are currently out of scope. 

Challenges for cosmetic industry 

Industry professionals must identify microplastics within complex ingredient mixtures. Staying compliant requires updating Product Information Files (PIF) and ensuring safety assessments account for new restrictions. Managing large product portfolios across multiple global markets with varying bans remains a significant operational hurdle.
